Policies and Procedures

2) Shipping and Handling:

All orders are shipped UPS ground unless an alternative method is requested and paid for by purchasing account.
For pre-sale items, standard shipping fees will apply.
Standard shipping is a minimum of $15.00 for orders $0 - $375 and 4.0% of order total for orders between $376 - $999.
Alaska/Hawaii shipping fees are minimum $20 for orders $0 - $375 and 5% of order total for orders between $376 - $1499.
Free ground shipping for orders over $1,000.00 ($1,500 for Alaska/Hawaii).

3) Shipping Turn Around:

Orders will be shipped within 48 hours of receipt or you will be notified.
Backorders for non-Internet orders will be billed when they ship at no extra shipping charge once in stock.
Backorders for Internet orders will be billed with the original order and will be shipped at no extra shipping charge once in stock.

4) Wholesale pricing:

For accounts retailing and charging for treatments, a copy of both a professional license and business license must be provided prior to first order (a copy of the Sales Tax License is required to be on file for all retailing accounts).

5) Orders:

The sale of samples, testers/replacements or professional products is strictly prohibited and may result in the forfeit of the Buyer's right to purchase products from Osmosis. Once accepted by Osmosis, orders cannot be cancelled or changed by Buyer. Buyer may not sure and shall not sell the Products to or for the benefit of any person whi is not an end-user consumer. Buyer may not and shall not resell Products to any other person or entity (including affiliates, subsidiaries, or other organization of which buyer is an owner or member).

6) Return Products:

Client Returns to wholesaler must be made within 30 days of end user's purchase of products, and must be shipped back to Osmosis at wholesaler's expense. Product(s) must be at least half full. On approval, an exchange or credit towards future orders will be made; no cash or credit card refunds are possible. Requests to Osmosis for client returns must be made within 10 days of client return to wholesaler.
New Osmosis Wholesalers are eligible for money back less shipping (with approval) on initial orders only within 30 days unless special permission is granted or approved.
Existing Osmosis Wholesalers can return products for approved reasons ONLY within 30 days of receipt of the product. Upon refund approval, for credit card only, a 2.5% service fee may be applied.
Missing/damaged product in each order must be reported within 72 hours of receipt. Photos of returned or damaged products may be required. Excessive returns may warrant client to be charged additional fees.
Osmosis has up to 48 hours to process all return requests.
All Returns are subject to a 25% restocking fee.

7) Professional Internet Sales:

Pricing cannot fall below the suggested retail provided by Osmosis for any Osmosis product listed on the internet. All internet accounts must be owned by the esthetician or physician that is purchasing Osmosis. This means no third party sales via the internet ie. Amazon, Ebay, etc. Violators of this policy will receive a warning (and 30 days to cure the problem) after the first violation. The account will be terminated after any additional violations or if they do not correct the initial violation within 30 days. No international sales are allowed.

8) Termination:

Osmosis may terminate the Agreement and sales to a Buyer at any time for any reason. Osmosis shall not be liable to Buyer for compensation, reimbursement, loss of lease, commitments in connection with the business, goodwill of Buyer, or any other actual or potential damages whatsoever as a result of any termination.

9) Law:

This Agreement and the sales of Products are governed by laws of the State of Colorado. Applicable sales tax for the state of receipt of shipment shall be charged on all orders unless appropriate and current sales tax certificates are on file with Osmosis. The defaulting party shall be responsible to reimburse the prevailing party all costs and expenses including reasonable attorney fees incurred in enforcing terms of this Agreement.

10) Insurance Requirements:

Professional Liability Insurance required. A copy of the Certificate of Insurance must be provided to Osmosis.
If purchasing account is charging for treatments, Osmosis requires a copy of the business license to be on file.

11) Methods of Payments:

Visa, Master Card, Amex, Discover, Electronic Bank Payment EFT
Check (Returned checks are subject to a $25 service fee and the account will be put on a cash only basis).
